Abstract

The article focuses on judicial interpretations of the U.S. Trafficking Victims Protection Act (TVPA) statutes including elements of prostitution, forced labor and peonage. Prior to TVPA, prostitution cases were decided under the Mann Act that makes the transport of a person in interstate or foreign commerce for any sexual activity a criminal offense. The 11th Circuit Court discussed in the United States v. Warren case the climate of fear that coercion may create in trafficking cases.
