Abstract

A summary is provided of recent court decisions in Massachusetts and New Jersey which dealt with the right of mental patients to refuse psychoactive drugs. The courts expressly stated a qualified constitutional right to refuse medication but left unclear what standards and procedures a state must follow if it seeks to override a refusal.
