Abstract

The Virginia Court of Appeals reversed a trial court's rape conviction of Yazid Abunaaj. The Court of Appeals found that the defendant had been denied an opportunity during his trial to rebut testimony that he was HIV-positive. The appeals court also ruled that the prosecution failed to comply with the rules regarding a taped conversation between the defendant and the victim. The taped evidence unfairly interfered with Abunaaj's ability to defend himself.
