Abstract

This article reviews arguments and jury deliberations froma rape trial that took place in spring 1999 and was retried 7 months later. It presents the circumstances of the case, the evidence and arguments of the prosecution and defense, discussions among jurors during the first trial, and the outcome of each trial. It also raises questions about the treatment of sexual assault victims in the courts, the effect of jury selection on the outcomes of trials, and the persistence of myths regarding women and sexual assault in American society.
