Abstract

In this article, the author presents some doubts on whether the justification of Feinberg's soft paternalism is better than the justification of Maniaci's moderate antipaternalism. After that, he briefly analyses two judgments on assisted suicide: one by the Italian Constitutional Court from 2019, and another by the German Constitutional Court from 2020, concluding that Maniaci mostly likely shares the ideas of German Constitutional Court. © 2021, Diritto e questioni pubbliche, Palermo.
