Abstract

This article analyzes the process of administrative and judiciary changes relative to karoshi and karojisatsu compensation and its recognition as an occupational disease, by exploring the relationship between law, lawyers, and evolution of social conflict. These cases highlight the dialectical relationship between constraints and the possibility of singular actions. By using the two systems of compensation - social security and civil responsibility - Japanese lawyers relied on an innovative strategy by opposing administrative law and civil law with the administration and executive power to turn around a closed sphere of decision-making between experts without public debate. © 2021 Editions Juridiques Associees.
