Abstract

The paper is devoted to unlawful actions against minors in the Internet information and telecommunication network. The author presents statistical data regarding underage crime victims in the Russian Federation in 2009-2015, including information on crimes that are within the jurisdiction of the Investigative Committee of Russia. The author also analyzes legislation and law enforcement practice on criminal prosecution of persons guilty of sexual abuse with the use of online communication. He raises the issue of driving children to suicides in the so-called death groups and points out drawbacks in Art. 110 of the Criminal Code of the Russian Federation ("Driving to Suicide"). It is noted that the actions of the "suicide quest" organizers can be viewed as an infringement not only upon a person, but also upon public health and morals, which requires a different legal assessment within the active legislation. The author argues that advertising of narcotics, psychoactive substances and their precursors, plants containing narcotics, psychoactive substances or their precursors and their parts containing narcotics, psychoactive substances or their precursors, advertising of new potentially dangerous psychoactive substances should be qualified not as an administrative offence, but as a constituent element of preparing to sell them. The author points out that it is necessary to include in Art. 230 and 234.1 of the CC of the RF a number of aggravating circumstances connected with the involvement of juveniles in selling new, potentially dangerous psychoactive substances and the use of the Internet to sell them. The author concludes that it is necessary to improve legal mechanisms of counteracting crimes against children and adolescents with the use of the Internet, to use active legal norms effectively and to apply victimological prevention methods. © 2017, Baikal National University of Economics and Law.
