Abstract
|
This article gives an overview of important judgments concerning German traffic law, especially those of the German Federal Court, from July 2016 to autumn 2017. The presentation includes judgments dealing with the most important criminal offences of traffic law and some problems of common interest as far as the criminal procedure and the skimming off of profits in cross-border goods traffic are concerned.
An overview of important decisions on road traffic law in the period from mid-2016 to autumn 2017 is given. The focus is on decisions, primarily those of the 4th Criminal Senate of the Federal Court of Justice, on substantive criminal traffic law. Some decisions of the Higher Regional Courts are also dealt with, in particular those of procedural interest. Also worth mentioning is a decision by the Federal Court of Justice on the amount of forfeiture to be ordered in the event of violations of road traffic regulations in cross-border traffic and a decision by the Federal Administrative Court on the need for a medical-psychological examination (MPU) in cases of criminal withdrawal of a driver's license for driving under the influence of alcohol.

Es wird ein Ueberblick ueber wichtige Entscheidungen zum Strassenverkehrsrecht im Zeitraum von Mitte 2016 bis Herbst 2017 gegeben. Den Schwerpunkt bilden Entscheidungen, vornehmlich solche des 4. Strafsenats des Bundesgerichtshofs, zum materiellen Verkehrsstrafrecht. Behandelt werden ferner einige Entscheidungen der Oberlandesgerichte, insbesondere solche von prozessualem Interesse. Hervorzuheben sind ferner eine Entscheidung des Bundesgerichtshofs zur Hoehe des anzuordnenden Verfalls bei Verstoessen gegen strassenverkehrsrechtliche Vorschiften im grenzueberschreitenden Verkehr und eine Entscheidung des Bundesverwaltungsgerichts zur Notwendigkeit einer medizinisch-psychologischen Untersuchung (MPU) in Faellen einer strafgerichtlichen Entziehung der Fahrerlaubnis bei Fahren unter Alkoholeinfluss.
