Abstract

One of the important issues in the discussion of abduction of individuals from the perspective of jurisprudence, which is reflected in the opinions of jurists, is to consider kidnapping as one of the special examples of moharebeh and corruption on earth and even more dangerous and evil than them; Because kidnapping minus other crimes that may be associated with it, cause major security damage to public health and public safety. Abduction has many criteria for the crime of moharebeh and corruption on earth. In this article, while reading the texts and opinions of jurists and reflecting on the words of Islamic jurists, the compatibility of the titles of Moharebeh and corruption on earth is examined and after defining these titles and expressing their relationship with the issue of kidnapping, it is shown that in Islamic jurisprudence The truth and inclusion of the titles of moharebeh and corruption on earth in the form of "thief of war", "moharebeh" and "corruption on earth" has not been questioned and has always been considered by jurists and a type of kidnapping, especially armed kidnapping can be subject to moharebeh punishments Karim has been sentenced.

چکیده
از موضوعات مهم در بحث اختطاف اشحاص از منظر فقه که در آرای فقها نمود یافته است، شمردن
آدمربایی بهعنوان یکی از مصادیق خاص محاربه و افساد فی الارض و حتا خطرناکتر و شرورانهتر از آنان میباشد؛ زیرا آدمربایی منهای جرائم دیگری که ممکن است همراه با آن صورت گیرد، آسیبهای کلان امنیتی را بر سلامت جامعه و امنیت عمومی وارد میسازد. اختطاف واجد بسیاری از معیارهای

در این نوشتار ضمن بازخوانی نصوص و آرای فقها و تأمل در سخنان فقهای اسلام، انطباق عناوین محاربه و افساد فیالارض بر اختطاف مورد بررسی قرار میگیرد و پس از تعاریف عناوین مزبور و بیان رابطهی آنان با بحث اختطاف اشخاص، نشان داده میشود که در فقه اسلامی صدق و شمولیت عناوین
محاربه و افساد فی الارض در قالبهای "سارق الحر" "محاربه" "افساد فی الارض" با تردید مواجه نبوده است و همواره مورد توجه فقها بوده و گونههای از آدمربایی به خصوص آدمربایی مسلحانه میتواند مشمول مجازاتهای محاربه باشد که در قرآن کریم به مجازات آن تصریح شده است.
