Abstract

As part of a study on the potential use of photo-radar equipment on high-speed, high-volume roads, the Virginia Transportation Research Council conducted research on the legal issues raised by the use of photo-radar technology. An historical review of speed enforcement technology was conducted, starting with the time-distance method of speed enforcement and continuing through modern photo-radar technology. The various legal issues related to the use of photo-radar devices, both in staffed and unstaffed modes, are examined. In particular, potential constitutional challenges to the use of photo-radar, the admissibility of photographs produced by photo-radar under the pictorial testimony theory and the silent witness theory, requirements for legal service, and the need for federal approval for unstaffed use of photo-radar systems are discussed. Model enabling legislation for implementing photo-radar technology is provided.
