Abstract

This contribution focuses on the sentencing of children as well as the arrest and detention of children. With regard to the discussion on sentencing, the relationship between appeal and review proceedings is highlighted and the factors a sentencing court should keep in mind in the process are also explored. The contribution also examines the courts' approach towards the role of rehabilitation in determining an appropriate sentence. In the discussion on the arrest of children, issues that the police officials should keep in mind when they exercise their discretion to arrest a child or not is emphasised, and important guidance provided with regard to decisions pertaining to the detention of children. The role of the best-interests requirement is also discussed.
