Abstract

Stating of the problem. In many European countries, including Ukraine, a human-being, it's life and health, honor and dignity, inviolability and safety are the highest social values. It is pity, but these provisions still remains only as declarations. The reality has been and remains today are brutality, violence, aggression, terror, grave crimes, including murders, trafficking in human-being for the purpose of removal organs and tissues.

Recently, the UN has received a lot of statements on facts of trafficking in human organs and tissues. For today in the result of trafficking in organs 10% of surgical operations in the world carry out on kidney transplantation, moreover these organs very often removes from the women and children from poor countries. More often human organs and tissues becomes a subject of trafficking, because they can be used for the genetic experiments, religious and magic ritual. But most of all they are for sale for the transplantation. The aim of publication is to expose the provisions of principal international legal acts, which directs to counteraction trafficking in human organs and tissues.

The main results of study. Today the very high attention paid to the dangerous for society from the trafficking in human organs and tissues. As shows a result of analysis of investigation and court practices, the special feature of the committing crimes on removal of human organs and tissues for transplantation is that these crimes can be committed only by organized criminal groups.

We established during the study that in the role of different kind of participants of crime can be as physical persons and legal persons, as direct participant in trafficking in human-being for removal of organs and as a organizer and stimulator for another person to commit this kind of crimes.
