Abstract

The article explores various theories of corporate liability regarding human trafficking and forced labor to evaluate their strengths and weaknesses. It examines the U.S. Supreme Court pronounced economic realities test, which holds corporations equally responsible as joint employers with foreign contractors in this approach. It concludes that the test application to human trafficking and forced labor cases is effective as it is reflects the U.S. Fair Labor Standards Act (FLSA) standards.
