Abstract

The present paper examined where Romanian juvenile justice system stands in a time dominated by the re-emergence of the punitive answers to the juvenile crime and delinquency. The results of the analysis indicate that compared to other European and non-european systems, in Romania, the observance of the Human rights of the children in conflict with criminal law has been beneficial aiming mainly at (legal) protection as well as at avoiding the over-criminalization of the treatment of children in conflict with penal law. The conclusions of the paper emphasize that the Romanian Juvenile Justice System stands between retribution and rehabilitation, between the welfare tradition and the neo-liberal tendencies.
