Abstract

This article considers the preventive detention laws in England and Wales with special reference to the new mandatory life sentence that has recently replaced imprisonment for public protection (IPP). It considers what was wrong with IPPs and agrees that change was required, but questions whether the coalition government has introduced anything better. Looking at sentencing policy and practice in South Africa, England and Germany, it evaluates whether the new policy behind preventive detention in England and Wales is as David Cameron has stated tough, but intelligent too.
