Abstract

The Amendment to the Swiss Penal Code and the Military Penal Code, crimes against life and bodily integrity and against the family, June 23, 1989, contains the following provisions: A mother who kills her child during childbirth or while under the influence of the puerperal state will imprisoned. Incest is defined as a sexual act between ascendants and descendants, or between full or half siblings, and will be published with imprisonment. Minors will incur no punishment if they have been seduced. Penal action is barred at the end of 2 years. The crime of Adultery is repealed. A person who, while married, contracts a new marriage, or a person who contracts marriage with a married person, will be imprisoned. The suppression or falsification of civil status has been repealed. If a complaint is made, a person who has not furnished the alimony or allowance that he owes under family law, though he has the means to do so or could obtain the means, will be imprisoned. Authorities and departments designated by the cantons also have the right to press charges. They will exercise this right in the best interest of the family. The law against abandonment of a pregnant woman is repealed. Violations or failure of the duty to aid or educate a minor, thus endangering the minor's physical or psychological development, will be punished with imprisonment. If the delinquent person has acted through negligence, he may be punished with a fine rather than with imprisonment. The person who abducts a minor from, or refuses to hand a minor over, to the person exercising parental authority will be punished with imprisonment or with a fine.
