Abstract

The appeal of an intoxicated offender is no real success if the decision not to prolong the drivers licence withdrawal period and the issue of a licence by the appeal court is based on the fact that the prescribed period had lapsed. Due to the time factor only a pseudo-result is attained. The accused should thus in all reasonableness bear the full costs of the proceedings. The placing of these cases on an equal footing with such cases in which no right of appeal exists, should therefore be considered.
