Abstract

If drinking after the offence has to be considered with the reverse projection of a measured BAC there are two methods available for a reliable calculation. The reachable maximum BAC with drinking after the offence could be subtracted before or after the reverse projection of the lowest BAC. Both methods show sources of error under specific terms and conditions. It is necessary to examine the plausibility of drinking after the offence. A fractioned reverse projection, which already contains this examination of plausibility, is therefore the preferred method: at first the lowest BAC up to the beginning of the drinking after the offence will be calculated. A BAC below 0.15 (per mille) could be solely caused by drinking after the offence. For a BAC above 0.15 (per mille) the measurement has to be counted back up to the time of offence or the supposed end of resorption of the alcohol drunk before the offence.
