Abstract

The article describes two decisions concerning evidential breath alcohol test results passed by the Lower Court of Baden-Baden. Based on the statements of a medical and a technical expert respectively the probative value of the breath alcohol test result measured with Drager Alcotest 7110 Evidential was questioned due to fundamental doubts. It is shown that the specific arguments described in the sentence contradict the current knowledge in literature. Additionally, given the lack of specific objections in this particular case the court should not have ruled for an acquittal.
