Abstract

The Higher Regional Court in Hamm decided to ask the Federal Supreme Court whether, when determining the value of breath alcohol concentration, a reduction of 4% from the measured value should be taken into consideration for the memory effect. The court, in fact, presumes a reduction of 8%. Measurements taken by the PTB for the type approval of the Drager Alcotest 7110 Evidential MKIII indicate a memory effect of less than 1%. In contradiction to the current jurisdiction in Germany, where a safety supplement is added to the basic value of driving inability, the court introduced a safety reduction to be subtracted from the measured value. This leads to uncertainties regarding the application of legal limit values.
