Abstract

The (voluntary) participation of an alcohol-conspicuous motorvehicle driver in 'post-schooling' constitutes a mitigating circumstance in terms of section 6 subsection 1 of the Federal Act (behaviour after the act) which must be taken into account by the presiding judicial officer. Failure constitutes a reversible legal error which must be brought to his attention.
