Abstract

The intensification of the scientific dispute over the demands regarding the evaluation by medico-psychological examination centres of the re-examination of the unsuitability of motor vehicle drivers, led, for the first time, to the questioning of the usefulness of the present evaluation. The 'empirical research results' of the relapse probability of the alcoholic offender projected for ten years are viewed by the administrative lawyer skeptically and with reserve. With regard to the usefulness of the above mentioned evaluation, it is demanded that the correctness of the evidence submitted by the medico-psychological centres is reevaluated over a ten year period by an interdisciplinary committee. The judical officers responsible for the granting and withdrawal of driving licenses should, due to the special knowledge required in such cases, receive special training. Greater restriction in the implementation of the provisions is demanded of section 15bII2 of the relevant Act in terms of which only those personality aspects are to be examined which lead to justifiable doubts regarding the unsuitability of driving. The evaluators are challenged to pay more attention to their presentation to enable the lawyer to implement their recommendation. The evaluator is only then of any value if he translates his evaluation into a language understood by the lawyer. Hence, the author pleads for further education of the evaluator in regard to the judical aspects of his evaluation as the latter demands special considerations.
