Abstract

The author critically analyses the opinion of the Federal Court regarding Mofa-drivers (a bicycle with an engine capable of a speed not exceeding 25 km(h). In contrast with the Court's decision he is of the opinion that the level at which a person is incapable of driving can be fixed at 1,3(per mille). The investigations of Schewe at al (published in Blutakohol 17, 298) require an urgent reassessment by the Federal Court.
