Abstract

A Texas appeals court held that a prosecutor may make inferences about the emotional distress a rape victim may feel while awaiting HIV results after an attack. The defendant, convicted and sentenced for raping two women, claimed the judge unfairly allowed jurors to consider prosecution statements regarding the victims' HIV tests during the punishment phase of the trial. The appeals court disagreed, and upheld the trial judge's decision to allow reasonable inferences based on the facts at hand.
