Abstract

Kendell Spruce, a prison inmate in Arkansas, claimed he was raped by his cell mate and infected with HIV because the prison warden failed to protect him. The 8th Circuit Court agreed with Spruce by reversing a Federal judge's previous decision against Spruce. A document bearing the warden's signature indicated that the warden knew about Spruce's request to be reassigned to another cell because of sexual assaults by Spruce's cell mate. The Court considered this document as "direct evidence" that the warden knew of Spruce's risk of sexual assault.
