Abstract

This Act contains a number of provisions relating to the care, protection, and welfare of children under the age of eighteen in Ireland. Part II provides that it is the function of every health board to promote the welfare of children, including, identifying children not receiving adequate care or protection, taking such children under its care, accommodating homeless children, and furnishing adoption services. Part III sets forth rules on the protection of children in emergencies and authorizes authorities to enter premises without a warrant to remove children for delivery to health boards, which will then seek an emergency care order from the District Court. Part IV sets forth rules on care orders, for which health boards have the duty to apply when it appears that a child will not receive the required care or protection without such an order. Part V sets forth rules on jurisdiction and procedures and provides that the welfare of the child is to be the paramount consideration in any court proceedings. Part VI sets forth rules on the accommodation and maintenance of children in care, access to such children, provision of residential care, review of care cases, removal of children from placement, aftercare, and recovery of children removed from care, among other things. Part VII sets forth rules on the supervision of pre-school services such as day nurseries and day care centers. Part VIII sets forth rules on children's residential centers, including registration of such centers. Further provisions of the Act deal with administration, charges, prosecution of offenses, and the sale of solvents to children for the purpose of inhaling fumes.
