Abstract

More courts are admitting crash data retrieval (CDR) system data as evidence in trials, and both the prosecution and defense are changing their approach and opinion of CDR evidence. This question-and-answer article provides a district attorney's perspective on interacting with police investigators in the context of criminal crash reconstructions that involve CDR evidence. The questions address legal issues related to search warrants, vehicle seizure, the need of a traditional reconstruction, and obtaining the best data from the CDR.
