Abstract

This article describes a complicated legal case involving a DUI charge involving fatalities in the state of New Jersey. In this case, police charged one individual with DUI, called a friend of the accused to pick him up, and then the friend, disobeying instructions given to him by the police, allowed the accused drunk driver to get back into his vehicle and drive away. The accused drunk driver, after getting back on the road, later struck another vehicle killing himself and the driver of the other vehicle. The friend who disobeyed police instructions was subsequently charged with manslaughter for complicity in these fatalities. Legal and policy issues emanating from the circumstances of this case are discussed.
