Abstract

Edward T. Martin, a convicted rapist who claims he is HIV-positive, will be granted a new trial. The Berkshire (MA) trial judge, Superior Court Judge Charles R. Alberti, prevented a fair trial when he took extreme precautions to ensure the safety of others. Martin cut his hand and Judge Alberti heard Martin may try to escape using his blood as a weapon. During the trial, Alberti ordered Martin shackled in leg irons and a barrier to be set between him and the defense attorney. The appeals court ruled that there was no indication that Martin had been violent before and judged that the shackling was excessive. Judge Alberti also was found at fault for failing to inform the jury on how to properly assess information about Martin's HIV status, and for offering protective rubber gloves to the jury.
