Abstract

Human rights organizations and the international community have criticized the Military Commissions Act for failing to meet the minimum standards required by the Geneva Conventions Common Article 3. While the Act has many flaws regarding due process and overreaching provisions, this Comment focuses on the Act’s treatment of rape and sexual violence. Specifically, it looks at how the treatment of rape and sexual violence runs contrary to international standards and why this does not make good policy.
