Abstract

This Irish Act provides that a Health Board is a "fit person" within the meaning of the Children Act 1908 and thus has authority to take into its care neglected, ill-treated, and abused children. The Act was passed in response to an Irish Supreme Court decision, The State (D.) v. G., 2 November 1989, Irish Law Reports Monthly, 1990, p. 130, which held that a Health Board was not a "fit person" under the 1908 Act.
