Abstract

This Act inserts into the Australian Crimes Act 1990 provisions relating to apprehended domestic violence orders. It empowers a court to make domestic violence orders on complaint if "it is satisfied on the balance of probabilities" that a person fears the commission of domestic violence and the fear is "reasonable." An order may impose prohibitions or restrictions on the behavior of the defendant as appear "necessary or desirable" to the court. The Act also redefines various sexual offenses and adds language relating to 2 new offenses: sexual intercourse procured by intimidation, coercion, and other nonviolent threats and by taking advantage of one with intellectual disability.
