Abstract

The Indian court reversed the lower court acquittal of the defendant of the crime of abetting his wife to commit suicide. It held that instigating a person to commit suicide constituted abetment. It concluded that the husband had instigated the suicide of his wife by constantly demanding money from her, beating her, and telling her on the day of her death that she could provide him quick relief by dying on that day. In Gurbachan Singh v. Satpal Singh (All India Reporter, 1990, Supreme Court, p. 209) the Supreme Court also reversed a lower court acquittal of defendants on the charge of abetting a wife to commit suicide. In addition, in Subedar Tewari v. State of U.P. (All India Reporter, 1989, Supreme Court, p. 733) the court reversed a lower court acquittal of the defendant of bride burning. In Wazir Chand v. State of Haryana (All India Reporter, 1989, Supreme Court, p. 378), however, the Court reversed a conviction of abetment of suicide and upheld a conviction of the crime of harassment for dowry.
