Abstract

Even before it has come into force the Mental Capacity Act 2005 is to be amended. The government announced in this years Queen's speech that it will use the Act to introduce a power authorizing the deprivation of liberty of an incapable person in a care home or hospital where this is necessary to protect them from harm. District nurses will have such patients on their caseloads and will need to be aware of the requirements for the lawful detention of incapable adults.
