N2  - The article proposes a reflection on the judgment No. 50 of 2022 handed down by the Italian Constitutional Court and on the Trizzino legislative proposal currently being considered by the Senate, which raise serious perplexities. While the decision, which deemed inadmissible the referendum question, essentially resulted in a prior examination of constitutional legitimacy (backed by a slavish recall to the immovable criteria affirmed by the Court itself in the Cappato/Antoniani case), the abovementioned proposal can be appreciated for the procedure regulated therein, but not for its choice to include only assisted suicide practices, which contributes to perpetuate blatant discriminations against sufferers who cannot take the lethal drug themselves. © 2022 Pisa University Press.
