abstract="In this article theoretical and applied matters of the individualization of responsibility and punishment for crimes, committed in a manner of extremely brutal treatment, are researched. The results of a study of court practice on crimes, committed in a manner of extremely brutal treatment, inter alia its subject matter, sort and gravity of primary and additional punishments, their proper motivation, reasonableness of application of extenuating and aggravating circumstance etc., are demonstrated. The results of interviewing of a group of judges and employees of the Department of the Execution of Sentences on the matter of effectiveness of primary and additional punishments for the researched crimes are analyzed. The suggestions for improving penal part of some articles of the Criminal Code of Ukraine are made.
